WITHDRAWAL AND RETURNS

Right of withdrawal for consumers

Consumers have the right to withdraw from this contract within fourteen days without giving any reason (Section 11 of the Austrian Distance and Off-Premises Contracts Act, FAGG).

The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, take possession of the goods. If you ordered several goods in one order that are delivered separately, the period begins on the day on which you or a third party named by you take possession of the last item.

How to exercise your right of withdrawal

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement, for example by letter or email:

You may withdraw from the whole contract or from individual items. You may use the model withdrawal form below, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your statement before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs, without undue delay and no later than fourteen days from the day on which we receive your withdrawal. This does not include additional costs arising from your choice of a type of delivery other than the cheapest standard delivery we offer, such as express shipping.

We will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise. You will not be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied proof that you have sent them back, whichever is earlier.

You must send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal. The deadline is met if you send the goods before the fourteen days have expired. You bear the direct cost of returning the goods.

You are only liable for any loss in value of the goods if this results from handling that was not necessary to establish their nature, characteristics and functioning. Trying the goods on, as you could in a shop, is expressly not covered by this.

Exceptions to the right of withdrawal

Under Section 18 FAGG, the right of withdrawal does not apply, among others, to contracts for:

• goods made to the consumer's specifications or clearly personalised, for example custom-made pieces, individual colour orders, monograms or hats with pressed-on crystal elements.
• sealed goods that are not suitable for return for health protection or hygiene reasons, if their seal has been removed after delivery.

How your return works

After your withdrawal, we will get in touch with all details for the return. Please send the goods back well protected and, where possible, in their original packaging; this is not a condition for your right of withdrawal.

Statutory warranty

Independently of the right of withdrawal, you are entitled to the statutory warranty of at least two years. Details can be found in our terms and conditions (section 9). If an item is defective, please contact office@warm-me.com.
